EpicNest Professional Coaching provides educational coaching services in the following areas:

• Public speaking training and development
• Oratory excellence programs
• Professional communication skills enhancement
• Career advancement coaching

Our services are delivered through:

• One-on-one coaching sessions (in-person or virtual)
• Group workshops and training programs
• Online resources and materials

3. Eligibility and Registration

3.1 Age Requirement

You must be at least 18 years of age to use our services. By using our services, you represent and warrant that you meet this age requirement.

3.2 Account Registration

To access certain services, you may be required to create an account. You agree to:

• Maintain and promptly update your account information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access
• Accept responsibility for all activities under your account

We reserve the right to suspend or terminate accounts that provide false information or violate these Terms.

4. Booking and Scheduling

4.1 Session Booking

Coaching sessions must be booked in advance through:

• Phone consultation

4.2 Confirmation

All bookings are subject to availability and confirmation. You will receive a confirmation email with session details, including date, time, location (or virtual meeting link), and coach information.

4.3 Rescheduling

If you need to reschedule a session, you must provide at least 24 hours' notice. Rescheduling can be done by:

We will make reasonable efforts to accommodate rescheduling requests, subject to coach availability.

4.4 Cancellation by Client

Cancellations made less than 24 hours before the scheduled session may result in forfeiture of the session fee. See our Refund Policy for detailed information about cancellations and refunds.

4.5 Cancellation by EpicNest

We reserve the right to cancel or reschedule sessions due to:

• Coach illness or emergency
• Technical difficulties
• Force majeure events
• Other unforeseen circumstances

In such cases, we will notify you as soon as possible and offer alternative scheduling options or a full refund.

5. Fees and Payment

5.1 Pricing

Current pricing for our services is available on our website and includes:

• Single Session: ¥15,000 per 90-minute session
• Package of 5: ¥65,000 for five 90-minute sessions
• Intensive Program: ¥120,000 for ten 90-minute sessions

We reserve the right to modify our pricing at any time. Price changes will not affect services already purchased or sessions already booked.

5.2 Payment Methods

We accept payment through:

• Credit cards (Visa, MasterCard, American Express)
• Debit cards
• Bank transfers
• Approved online payment platforms

5.3 Payment Terms

Payment is required at the time of booking unless alternative arrangements have been agreed upon in writing. For package purchases, full payment is required upfront unless a payment plan has been approved.

5.4 Late Payment

Failure to make timely payment may result in:

• Suspension of services
• Cancellation of scheduled sessions
• Late payment fees
• Referral to collection services

5.5 Taxes

All fees are exclusive of applicable taxes. You are responsible for paying all applicable taxes associated with your purchase.

6. Client Responsibilities

As a client of EpicNest, you agree to:

• Attend scheduled sessions on time and prepared
• Complete assigned exercises and homework
• Actively engage in the coaching process
• Provide honest feedback about your progress

6.2 Professional Conduct

• Treat coaches and staff with respect and professionalism
• Communicate clearly about your goals and needs
• Refrain from any harassing, abusive, or inappropriate behavior
• Respect confidentiality of group sessions

6.3 Technical Requirements (for Virtual Sessions)

• Ensure stable internet connection
• Have functioning camera and microphone
• Use a quiet, private location for sessions
• Test technology before scheduled sessions

6.4 Honesty and Disclosure

You agree to provide accurate information about your background, goals, and any factors that may affect your coaching experience.

7. Our Responsibilities and Limitations

7.1 Professional Services

We will provide coaching services with reasonable skill and care, using qualified and experienced coaches.

7.2 Nature of Coaching

You acknowledge and understand that:

• Coaching is an educational and developmental service
• Coaching is not therapy, counseling, or medical treatment
• Results vary based on individual effort and circumstances
• We do not guarantee specific outcomes or results
• Success depends largely on your commitment and application

7.3 No Guarantees

While we strive to provide excellent service, we cannot and do not guarantee:

• Job placement or interview success
• Specific career advancement outcomes
• Complete elimination of public speaking anxiety
• Achievement of any specific personal or professional goals

7.4 Limitation of Liability

To the maximum extent permitted by law, EpicNest shall not be liable for:

• Indirect, incidental, or consequential damages
• Loss of profits, revenue, or business opportunities
• Damages exceeding the amount paid for services
• Damages resulting from your failure to follow coaching advice
• Technical difficulties or service interruptions

8. Intellectual Property Rights

8.1 Our Content

All content on our website and provided during coaching sessions, including but not limited to:

• Text, graphics, logos, and images
• Coaching materials and worksheets
• Videos and audio recordings
• Training methodologies and frameworks
• Software and website design

is the property of EpicNest or our licensors and is protected by copyright, trademark, and other intellectual property laws.

8.2 Limited License

We grant you a limited, non-exclusive, non-transferable license to access and use our materials solely for your personal, non-commercial use in connection with the coaching services you have purchased.

8.3 Restrictions

You may not:

• Copy, reproduce, or distribute our materials without permission
• Modify, adapt, or create derivative works
• Use our materials for commercial purposes
• Remove copyright or proprietary notices
• Reverse engineer or attempt to extract source code
• Share login credentials or account access

8.4 Feedback

Any feedback, suggestions, or ideas you provide to us become our property, and we may use them without compensation or attribution to you.

9. Confidentiality

9.1 Our Commitment

We respect the confidential nature of the coaching relationship. Information you share during coaching sessions will be kept confidential, except:

• When there is imminent danger to you or others
• For anonymous use in case studies (with identifying details removed)

9.2 Your Commitment

In group coaching or workshop settings, you agree to maintain confidentiality regarding information shared by other participants.

10. Termination

10.1 Termination by You

You may terminate the coaching relationship at any time by providing written notice. Refunds for prepaid services will be handled according to our Refund Policy.

10.2 Termination by Us

We reserve the right to terminate or suspend your access to services immediately, without prior notice, if:

• You breach these Terms and Conditions
• You engage in inappropriate or abusive behavior
• You fail to make required payments
• You provide false or misleading information
• Continuation of services is not in the best interest of either party

10.3 Effect of Termination

Upon termination:

OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that:

• Our services will meet your specific requirements
• Our services will be uninterrupted, timely, secure, or error-free
• Results obtained from our services will be accurate or reliable
• Any errors in our technology or content will be corrected

12. Indemnification

You agree to indemnify, defend, and hold harmless EpicNest, its officers, directors, employees, coaches, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from:

• Your use of our services
• Your violation of these Terms
• Your violation of any rights of another party
• Your negligent or wrongful conduct

13. Governing Law and Dispute Resolution

13.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of Japan, without regard to its conflict of law provisions.

13.2 Jurisdiction

Any legal action or proceeding arising out of or relating to these Terms shall be brought exclusively in the courts located in Osaka, Japan, and you consent to the jurisdiction of such courts.

13.3 Dispute Resolution

Before filing any formal legal action, parties agree to attempt to resolve disputes through:
